Schengen Information System (SIS)

The Lawyer, Mrs. Kasatkina-Kouskou Svetlana, provides services related to  the personal data of undesirable foreigners from the SIS and on the providing of information concerning the registration of data, as well.

The gradual abolition of checks at common borders of the  State members of the Schengen Agreement was approved, under the regulations governing these States, with further purpose the free movement of citizens and the affordable movement of goods and services that will lead to a more effective collaboration.

However, the question of the united rule of law in the territory of the States that have signed the Schengen Aggreement, concerning the citizens of these States as well as the nationals who are temporarily or permanently residing in their territory was set, in addition to the issue of the “open space”. The Convention was adopted by the application of a single rules, regulations and the procedures, which is a basis for cooperation between the members of the Schengen Agreement, in the field of justice and home affairs.

Greece, as a member of the European Union, has ratified the Convention, which regulates the control of borders, passing through the external and internal borders, the entry and exit of foreigners, who have been granted visas, including tourists, as well as control issues and legal residence and asylum, but also other issues such as migration and the general operation of the control system about foreign nationals of Schengen, in order to ensure the proper software use of personal data that have been included in the Schengen Information System.

The information system includes the following elements:
•   Persons wanted
•   Foreigners-unwanted persons for the entire Schengen area
•   Missing- or those in need of protection because of imminent danger
•   Persons who participated as witnesses at trial
•   Persons or objects belonging to a particular person (including vehicles) which may be related to emergencies, with the commission of a serious crime, if there is a threat to public safety of a Schengen member State. And other types of information

For various reasons associated with complete control over the situation of foreigners, information on their account in the National List of Unwanted Persons in Greece is also recorded in the list of unwanted persons of the Schengen Information System.

However, the program level of detail of the data of Schengen Information System in its current form, is not designed for an additional number of member States of the European Union and therefore, further examination of information that will enable the introduction of new features, is required. Plus, its replacement by the second generation of SIS, which allows the inclusion of other elements, in addition to all those already provided (such as photographs, fingerprints), has already begun. The new system is aimed at maintaining a high level of security within the framework of freedom, safety and justice in the European Union, by supporting operational cooperation between police and judicial cooperation in criminal matters.
