Recognition of Foreign Judgments in Greece

The implementation of the immigration policy of the State and the development of international relations in the modern era of mutual cooperation between the countries is the result of a series of regulatory documents. In general each sector of the foreign policy, is a distinct and multifaceted process, that requires careful consideration of a group and in some cases of an individual approach so as to produce measures, decisions and laws.

As for the legal side of international relations for the recognition and enforcement of foreign judgments countries enter into bilateral or multilateral agreements.  However, the decisions and their content are documents which came into force in the State in which the judgment was issued and are not recognized automatically.

According to EU regulations and Greek Law, it is possible to recognize a foreign decision, which confirms the validity of equivalence of documents on the territory of Greek Republic and determines the equality of citizens, work, family and other rights and the obligations of parties set out in Decision. Currently, the most pressing issues in the adoption by Greece of judgments of other states are still decisions to divorce, child adoption, decision to heritage and other.

As a rule the decision is recognized, but in some cases its enforcement is necessary as a prerequisite for the recognition of foreign judgments. It should be emphasized that the process of enforcement, admissibility and the possibility of recognition of foreign judgments, are determined in accordance with legal rules and laws of the country and the international agreements in which it is a party.
